Surveys, subdivisions and condos are fundamental parts of a property law practice in PEI. Time is often of the essence in a property transaction as well. Be sure you know the uses, limitations and peculiarities of these important pieces of the property law puzzle so that you can navigate transactions efficiently and with confidence to give your clients the best results while safeguarding your practice against claims in an area of the law rife with litigation potential.
This CLE is presented by the CBA PEI / Law Society Joint Continuing Education Committee and is chaired by Kim McNeill, Q.C and Kerri Seward Carpenter. This Continuing Legal Education Session will provide 3.5 hours of CPD.
- Condominium Law in Prince Edward Island– Presented by Patrick I. Cassidy, Q.C., Cox & Palmer, Halifax. This presentation will explore Condominium Law in Prince Edward Island today and future growth possibilities compared to other Atlantic Provinces. Included will be a discussion on the range of legal services required in the area of Condominium Law including; acting for developers, acting for existing condominium corporations, acting for buyers and sellers of condominium units and potential areas of condominium litigation.

- Surveys: They Work Great If You Know How to Use Them! - Presented by Geoff Connolly, Q.C., P.Eng., Stewart McKelvey and Serge Bernard, P. Eng., PEILS, Les Arpentages Bernard Land Surveys Inc. Surveys form the backbone of most real estate transactions and developments, and unfortunately are also at the centre of many ligation files. Our presenters will cover: what real estate lawyers should be telling their clients about survey requirements; how to properly qualify an opinion letter involving real estate and boundaries; common residential boundary issues that are often at the heart of boundary controversy; components and benefits of the Surveyor's Real Property Report (SRPR); the role of surveys and surveyors' testimony as evidence in litigation matters; and, the important distinctions between title insurance and surveys.
- Subdivision: Divide and Conquer (Your Subdivision Woes) - Presented by Eugene M. Lloyd, CET, Chief Development Officer with the Department of Communities, Land and Environment. This presentation will provide an overview of the department’s role in development and subdivision for the Province as well as some insight into how and why they do what they do, what information is required from applicants, jurisdiction, tools and resources used to evaluate proposals and some ‘tricks of the trade’.

Registrants who cancel within 24 hours of the CLE or who do not show will not be refunded any portion of the registration fee, but the registrant will be entitled to receive a copy of the CLE materials.
