In 2022, Prince Edward Island became the first Canadian province to introduce legislation regulating the content and use of non-disclosure agreements for all forms of harassment or discrimination. In this session,
Brenda Picard, K.C., the Executive Director the PEI Human Rights Commission, will review the
Non-Disclosure Agreements Act, providing clarification on the following questions:
· To what agreements does this Act apply?
· What is a non-disclosure agreement?
· Can the parties enter into a non-disclosure agreement if they both want to?
· What is the process of entering into a non-disclosure agreement? When will it be enforceable?
· What cannot be included in a non-disclosure agreement?
· How do ‘non-disparagement’ agreements fall under the Act?
· What can the parties agree to keep confidential?
This session is relevant to complainant and respondent counsel as well as those who provide independent legal advice regarding settlement agreements.
